1. Acceptance of Terms

By accessing or using the website of Savar Sethi Studio (hereinafter "SSethi Studio," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms are governed by the provisions of the Indian Contract Act, 1872, the Information Technology Act, 2000, and the rules made thereunder.

2. Description of Services

SSethi Studio provides 3D art, game art, architectural visualization, photorealistic product rendering, and related creative services ("Services"). The exact scope, deliverables, timelines, and fees for any engagement shall be as agreed in a separate written agreement or statement of work between us and the client.

3. Intellectual Property

3.1 Our IP

All content on this website — including but not limited to text, graphics, logos, portfolio works, fonts, and software — is the property of SSethi Studio or its licensors and is protected under Indian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

3.2 Deliverables

Upon full payment, clients receive the rights explicitly granted in their agreement with us. Unless otherwise stated, SSethi Studio retains the right to display completed works in its portfolio, website, and marketing materials.

4. AI Disclosure & Generative AI Policy

SSethi Studio may employ artificial intelligence, machine learning, and generative AI tools ("AI Tools") as part of its creative and production workflow. This section sets out the terms governing such use and is intended to protect both the studio and its clients.

4.1 Use of AI in Service Delivery

We may use AI Tools for ideation, texture generation, upscaling, rendering optimisation, procedural modelling, and other production tasks. The extent of AI involvement varies per project and is disclosed to clients upon request. Final deliverables are reviewed and refined by human artists to meet professional standards.

4.2 No Guarantee of Copyright in AI Outputs

The legal status of AI-generated content under Indian copyright law (Copyright Act, 1957) and international treaties remains unsettled. To the extent that any deliverable incorporates AI-generated elements, SSethi Studio makes no representation or warranty that such elements are eligible for copyright or other intellectual property protection in any jurisdiction. Clients accept the risk that certain AI-generated outputs may not be protectable.

4.3 Client Warranties

You represent and warrant that any content, data, or materials you provide to us ("Client Materials") do not and will not violate any third-party intellectual property rights. You agree not to submit Client Materials that were generated by an AI system in a manner that would infringe the rights of any third party.

4.4 Limitation of Liability for AI Outputs

To the fullest extent permitted by applicable law, SSethi Studio shall not be liable for any claim, loss, or damage arising out of or relating to:

• The use of AI-generated outputs in client projects;
• Any unintended resemblance between AI-generated outputs and existing third-party works;
• Any changes in legal or regulatory treatment of AI-generated content after delivery.

4.5 Data Input into AI Systems

Where we use third-party AI Tools, Client Materials may be processed by those tools' servers, which may be located outside India. By engaging our Services, you consent to such processing. We will use reasonable endeavours to select AI Tools that offer adequate data protection, but we cannot guarantee that any third-party AI Tool will maintain confidentiality of Client Materials. You must not submit trade secrets or highly confidential information through any AI system unless we have expressly confirmed in writing that the system offers a data-protection guarantee.

5. User Representations

By using our website, you represent and warrant that:

• You are at least 18 years of age or accessing the website under the supervision of a parent or guardian;
• You will not use the website for any unlawful purpose or in violation of these Terms;
• Any information you submit (including via any contact or signup forms) is accurate and truthful.

6. Limitation of Liability

To the maximum extent permitted under the Information Technology Act, 2000, and Indian law, SSethi Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of our website or services. Our total liability for any claim shall not exceed the amount paid by you to us for the specific service giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless SSethi Studio, its proprietor, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of or related to your breach of these Terms or your violation of any applicable law.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.

Before initiating legal proceedings, the parties shall attempt to resolve the dispute through good-faith negotiations. If the dispute remains unresolved for 30 days, either party may refer the matter to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Ahmedabad by a sole arbitrator appointed by mutual agreement.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website after such changes constitutes your acceptance of the new Terms.
